Dog Bite Case Study

Our client was a wonderful seven-year old boy playing soccer in his neighbor’s yard when he was attacked by dogs that had gotten loose from their pen. After the attack, the young boy was left with scars on his lip, face and neck. When we first made the claim the insurance company denied liability arguing that the dogs had never showed any violent propensity and our client was trespassing at the time of the incident. We pursued the case aggressively through litigation and we tracked down multiple witnesses who testified that this was not the first time the dogs escaped. Through eyewitness testimony we were able to prove that the animals had exhibited violent behavior on a prior occasion. After securing that evidence and before trial the insurance company offered the full $1,000,000 insurance policy limit to the child and his family.
